ANJANA MISHRA ORAL ORDER 13-08-2015 Heard learned counsel for the petitioners and the learned counsel for the State.
The petitioners are apprehending their arrest in connection with Muffasil P.S. Case No.114 of 2015 for allegedly having committed the offences under Sections 341, 323, 379, 504/34 of the Indian Penal Code and Section 3(i)(x) of the S.C./S.T. Act.
Learned counsel for the petitioners submits that the
Patna High Court Cr.Misc. No.34047 of 2015 (2) dt.13-08-2015 2/2 provisions of S.C./S.T. Act would not be attracted in the present case as, admittedly, the occurrence has taken place in the house of Md. Alamgir @ Alamgir Mian and that the allegations of theft and Marpit are also quite frivolous.
Considering the aforementioned submissions and also the fact that the petitioners have no criminal history, let all the petitioners, above named, in the event of their arrest or surrender before the court below within a period of three weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Aurangabad, in connection with Muffasil P.S. Case No.114 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
