JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 05-08-2022 Heard learned counsel for the petitioner and learned APP for the State through virtual court proceedings. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 147, 149, 341, 323, 353, 120(B) of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act. 15 liters of country made liquor has been recovered from the verandah of the house of the petitioner. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. It is further submitted that there is no recovery from the conscious possession of the petitioner and he has got no criminal antecedent as stated in paragraph-3 of the bail application.

Accordingly, the prayer for anticipatory bail of the petitioner is rejected in connection with Saraiya P.S.
