The petitioner seeks regular bail in connection with Rajauli P.S. Case No. 102 of 2015, registered for the offences punishable under Sections 452, 326, 307 and 398 of the Indian Penal Code and under Section 27 of the Arms Act. Allegation against the petitioner is that the petitioner and other accused persons surrounded the informant and this petitioner has fired on the chest of the informant causing injury to him.

It has been submitted on behalf of the petitioner that the petitioner has falsely been implicated due to earlier enmity and in re-statement, the informant has stated that all the accused

Patna High Court Cr.Misc. No.56118 of 2017 (2) dt.23-11-2017 persons had covered their faces by the mask and as such identification of the petitioner is not possible. The petitioner is in custody for four months.

Heard learned APP also.

Having heard both sides, considering the facts and circumstances of the case and nature of allegation, I am not inclined to release the petitioner on bail at this stage. Accordingly, the same is rejected.

However, the trial court is directed to expedite the trial and try to conclude the same within a period of one year. (Vinod Kumar Sinha, J) KKSINHA/- U T
