JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 27-03-2019 Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with Case No. 16 (O) of 2019 for the offence under Section 30(a) of the Bihar Excise (Amendment) Act, 2018.

Learned counsel for the petitioner submits that the petitioner is a lady and she has got no criminal antecedent. The petitioner is in custody since 11.02.2019. He further submits that in the instant case total 83.88 litres of foreign liquor was seized from the joint family house and not from the conscious possession of the petitioner.

Considering the fact that the petitioner is a lady and she has got no criminal antecedent, the petitioner, named above, is directed to be released on bail on furnishing bail bonds of

Patna High Court CR. MISC. No.18537 of 2019(2) dt.27-03-2019 2/2 Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-IIcum-Special Judge, Excise Act, Buxar in connection with Case No. 16 (O) of 2019.
