The petitioners seek bail in connection with Nokha P.S. Case No. 299/2017 dated 02.10.2017 instituted for the offences under Sections 147, 148, 149, 341, 323, 307, 353, 436, 427, 504, 153(A), 295(A) and 505(C) of the Indian Penal Code. It has been alleged in the F.I.R. that during the immersion of the statue of Goddess Durga, people of two different communities fought amongst themselves. However, the dispute was settled at that time. Later, about 500 to 600 people assembled at the police station and committed acts of arson, loot and also damaged the public property.
The petitioners have been named in the F.I.R., but
Patna High Court Cr.Misc. No.57048 of 2017 (2) dt.06-12-2017 2/2 without any specific allegation.
They are in custody since 03.10.2017. Other accused persons, who are similarly situated, have been granted bail by different Benches of this Court. The petitioners do not have any criminal antecedent.
Regard being had to the aforesaid facts, the petitioners above named are directed to be released on bail on their furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Sasaram, Rohtas in connection with Nokha P.S. Case No. 299/2017.
