JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 17-08-2020 Heard learned counsel for the petitioner and learned APP for the State through virtual court proceeding. The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 419, 420, 467, 468, 471, 120(B) of the Indian Penal Code. Allegation against the petitioner is of committing forgery and executed sale deed by planting him in lieu of Md. Haider.

Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case due to enmity out of land dispute. The similarly situated co-accused have been granted anticipatory bail by the Co-ordinate Benches of this

Patna High Court CR. MISC. No.16896 of 2020(2) dt.17-08-2020 2/2 court vide order dated 21.09.2017 passed in Cr. Misc. No. 40771 of 2017 and order dated 21.02.2018 passed in Cr. Misc. No. 58729 of 2017 is at Annexure-2 Series of the bail petition. The petitioner has clean antecedent.

Learned APP for the State opposes the prayer for bail petition.

In the aforesaid facts and circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of six weeks from the date of receipt of the order, be released on anticipatory bail on furnishing bail bonds of Rs. 25,000/- (rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Araria in connection with Complaint Case No. 1178C of 2015, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
