JUSTICE SUDHIR SINGH ORAL ORDER 29-09-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 147, 148, 149, 326, 307 of the Indian Penal Code and 27 of the Arms Act.
Allegation against petitioner is that he along with other accused persons came at the house of informant and petitioner gave gun shot injury upon his (informant) son. It has been submitted on behalf of the petitioner that he is in custody since 8.5.2016. Chargesheet has been submitted against petitioner. No allegation of tampering of witnesses is alleged against petitioner. From perusal of the case diary it is evident that after more than one year the injury report was given to the investigating officer. The said injury report does not indicate the nature of injury whether it is grievous or simple. On behalf of the State, it is submitted that petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond
Patna High Court Cr.Misc. No.34318 of 2016 (3) dt.29-09-2016 2/2 of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Addl. Chief Judicial Magistrate, Naugachia, Bhagalpur, in connection with Bihpur P.S. Case no. 154 of 2015.
