The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 147, 148, 149, 323,504, 452 and 380 of the Indian Penal Code and section 27 of the Arms Act.
Accusation is of making attempt to strangulate the informant for withdrawing the earlier murder case instituted by the informant and robbing cash, ornaments and other articles from the house of the informant.
It is submitted by learned counsel for the petitioner that accusation is omnibus and general. The petitioner is in Jharkhand police. A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. There
Patna High Court Cr.Misc. No.34101 of 2015 (2) dt.25-08-2015 2/2 is no recovery from the petitioner nor any injury has been caused to the informant.
The aforesaid facts constitute ground for consideration of prayer for regular bail.
Let the learned Court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders within a period of six weeks in connection with Fatehpur P.S. Case No.209 of 2011, pending before the learned Chief Judicial Magistrate, Gaya.
With the above observation, this application is, accordingly, disposed off.
