Heard learned counsel for the petitioner and learned A.P.P for the State.

The petitioner seeks bail in Laheriasarai (Benta OP) P.S. Case No. 330 of 2020, registered for the offence punishable under Section 307 and other allied sections of the Indian Penal Code.

As per the prosecution case, this petitioner and 03 accused persons demanded Rs. 10 lakh as extortion from the informant. On refusal, this petitioner and other accused persons fired upon the informant which hit his left hand. It is submitted on behalf of the petitioner that petitioner has falsely been implicated in this case. In fact, there

Patna High Court CR. MISC. No.28777 of 2021(5) dt.21-09-2021 2/2 are two groups of students and due to enmity name of this petitioner has been dragged in this case. No extortion was demanded by this petitioner. Petitioner is in custody since 26.12.2020 having no criminal antecedent.

Learned APP however, vehemently opposed the prayer for bail and submitted that there is specific allegation against this petitioner of demand of extortion and on refusal petitioner is alleged to have fired upon the informant. Considering the nature of accusation, I am not inclined to enlarge the petitioner above-named on bail. Accordingly, the same is rejected.
