The petitioner seeks bail in a case registered for the offence punishable under Sections 341, 323, 379, 384, 427, 504 and 506/34 of the Indian Penal Code and Sections 37(b) and 37(c) of the Bihar Prohibition and Excise Act, 2016. Petitioner along with co-accused Snil Kumar is said to have demanded extortion money of Rs. 50000/- from the informant and on his denial damaged the road and sign board of MGNREGA and looted cash and belongings of the informant in inebriated condition.
It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from the conscious physical possession of the petitioner. He had never
Patna High Court Cr.Misc. No.52704 of 2018 (2) dt.27-08-2018 2/2 consumed any liquor. He happens to be teetotaller. The allegation levelled against the petitioner is general and omnibus in nature. He never made any demand and has no concern with the aforesaid occurrence. He has been falsely implicated in the case by the informant due to animosity and with ulterior motive. Though five more criminal cases have been lodged against the petitioner, but he is on bail in the aforesaid cases. He has been languishing in custody since 09.06.2018. Similarly situated co-accused, namely, Sunil Yadav has been enlarged on bail by a co-ordinate bench of this court vide order dated 10.07.2018 passed in Cr. Misc. No. 39903 of 2018.
Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned 2nd Addl. Sessions Judge cum Special Judge, Excise, Saharsa in connection with Special (Excise) Case No. 302 of 2018 arising out of Bihra P.S. Case NO. 106 of 2018.
