The present matter is being taken up out of turn on the mentioning slip filed on behalf of the petitioner stating therein that the petitioner is a student of B.B.A. Bihar University and her examination is scheduled to be held from 01.10.2021. Let the mentioning slip filed on behalf of the petitioner be kept on record.

Learned counsel for the petitioner is directed to remove the defects, as pointed out by the Office, within a period of eight weeks.

The petitioner is apprehending her arrest in a case registered under Sections 302 read with 120B of the Indian Penal Code and 27 of the Arms Act.

No.29691 of 2021(2) dt.30-09-2021 2/3 The prosecution allegation, in short, is that the accused persons, variously armed, fired at the son of the informant due to which he sustained injury and later succumbed to the injury. It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. The petitioner is not named in the F.I.R. The name of the petitioner has come on the confessional statement of coaccused. The allegation of assault is on co-accuseds, namely, Mritunjay Kumar Thakur and Jay Mangal Jha. The petitioner is a lady.

On behalf of the State, it is submitted that the petitioner is not named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, in the event of arrest/surrender before the learned court below within a period of twelve weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. -II, Sheohar in connection with Purnahiya P.S. Case No. 75/20, subject to the conditions as laid down under Section 438(2) of
