JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 12-08-2015 Heard learned counsel for the petitioner and learned Assistant Public Prosecutor for the State.

This application for grant of anticipatory bail arises out of Dalsinghsarai (Ghataho) P.S. Case No. 560 of 2014, disclosing offences under Sections 147, 149, 448, 341, 323, 427, 32, 353 and 379 of the Indian Penal Code.

As per the prosecution case, a mob led by the petitioner and other persons, 100 to 150 in number, created nuisance to the Police Station and damaged certain articles in the Police Station. Allegedly, they took away some money from the pocket of one Ganga Prasad Singh.

Learned counsel for the petitioner submits that petitioner is an old lady.

Patna High Court Cr.Misc. No.31842 of 2015 (2) dt.12-08-2015 2/2 Keeping in view the nature of allegation and the fact that the petitioner is an old lady, I am inclined to grant privilege of anticipatory bail to the petitioner.

Accordingly, this application is allowed. Let the petitioner, above-named, in the event of her arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Dalsinghsarai (Samastipur) in connection with Dalsinghsarai (Ghataho) P.S. Case No. 560 of 2014, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioner shall present herself before the police/Court, as the case may be, as and when required and in the event of failure on her part to appear before the Court on two consecutive occasions, her bail bonds shall liable to be cancelled.
