The petitioner seeks bail in a case instituted under Sections 399, 402, 414, 328 of the Indian Penal Code and Sections 25(1-B)a, 26, 35 of the Arms Act.
One half filled liquid, upon which, Anesthetic Ether I.P. was written along with a mobile phone are said to have been recovered from the possession of the petitioner. It has been submitted on behalf of the petitioner that the petitioner is in custody since 06.06.2016. The charge sheet has been submitted in the present case. The petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. No arm is said to have
Patna High Court Cr.Misc. No.31628 of 2016 (3) dt.26-09-2016 2/2 been recovered from possession of the petitioner. The mobile which has been recovered belongs to the petitioner. On behalf of the state it has been submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-IV, Nalanda at Biharsharif, in connection with Rajgir P.S. Case No. 105 of 2016.
