JUSTICE SANJAY KUMAR ORAL ORDER 13-12-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner seeks bail in connection with Chowk Police Station Case No. 281 of 2017 registered for offences under sections 20, 22, 23, 24, 25 and 27 of the N.D.P.S. Act. It appears that this petitioner was arrested by Police on 20.09.2017 and on search 40 grams Ganja containing in 15 sachets was recovered from his possession. It has been submitted that the petitioner has wrongly been implicated in the present case. He has clean antecedent and is in custody since 21.09.2017. Further submission is that the petitioner has one more case, vide Chowk Police Station Case No. 185 of 2015, which was filed on account of land dispute in which he is on bail. Patna High Court Cr.Misc. No.57265 of 2017 (2) dt.13-12-2017 2/2 and circumstances of the case, the above named petitioner is directed to be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned District and Sessions Judge-Special Judge, Patna in connection with Chowk Police Station Case No. 281 of 2017, subject to the following conditions:- (i) One of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court.

(ii) The petitioner will not induce any witness or tamper with the evidence.

(iii) If the petitioner is found in similar type of offence in future, the prosecution will have liberty to move for cancellation of his bail. (iv) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court and on the event of failure on his part to appear before the court below on two consecutive dates without showing any genuine reasons, the prosecution is free to move for cancellation of his bail.
