The petitioner seeks bail in connection with Saraiya P.S. Case No. 878/2019 instituted for the offences under Sections 399/402/414 of the Indian Penal Code and 25(1-b) a/26/35 of the Arms Act.

From bare perusal of the allegation as alleged in the FIR, it would manifest that recovery of one loaded country made pistol from the possession of the petitioner. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. The similarly situated co-accused, namely, Deepak Kumar & Rajesh Kumar have been granted bail by different co-ordinate

Patna High Court CR. MISC. No.28600 of 2021(2) dt.23-11-2021 2/2 Benches of this Court vide order dated 01.09.2020 & 19.10.2020 passed in Cr. Misc. No.22568/2020 and Cr. Misc. No.27265/2020. The petitioner is languishing in judicial custody since 31.12.2019 and charge sheet has been submitted in this case. The petitioner has got no criminal antecedent, which is mentioned in para 3 of the bail petition.

Learned APP for the State vehemently opposes the prayer for bail application.

Considering the facts aforesaid, the petitioner, above named, is directed to be released on bail on his furnishing bailbonds in the sum of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-IV (West), Muzaffarpur in connection with Saraiya P.S. Case No.878/2019.
