Petitioners apprehend their arrest in a case under sections 304B and 34 of the I.P.C.
The father of the deceased alleged that his daughter was married with Amarjee Paswan in the year 2010 but thereafter all the accused persons demanded Rs.3 lacs. It is also alleged that they sprinkled kerosene oil and burnt his daughter to death. The informant and his wife are eye witnesses to the occurrence and they have very categorically supported the case of the prosecution.
Learned counsel for the petitioners submits that the petitioners are father-in-law and mother-in-law of the deceased. The informant has, of course, stated that the deceased died due to burning but in the subsequent statement, he made contradictory statement. Other witnesses have not supported the case of the prosecution.
Patna High Court Cr.Misc. No.40418 of 2014 (2) dt.25-03-2015 On perusal of the record, it appears that the informant and his wife went to see their daughter and in their presence, the petitioners and other accused persons are alleged to have burnt their daughter to death. The Post Mortem Report shows that the deceased got 100% burn injury.
Considering the facts and nature of allegation, I am not inclined to enlarge the petitioners on anticipatory bail and according, the same is rejected.
