The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341, 323, 353, 427, 384, 504, 506/34 of the Indian Penal Code.

The prosecution case is that the informant being In-charge Headmaster of Upgraded Middle School, Rampatti, Singheshwar, who was being assaulted, abused and thereby obstructed from discharging the official duty. It is submitted by the learned counsel for the petitioners that accusation is omnibus and general and due to

Patna High Court Cr.Misc. No.35343 of 2015 (2) dt.03-09-2015 previous enmity the accusation has been levelled. There is counter version of the occurrence also. Statement has been made in para-3 of the petition that petitioners have no criminal antecedent.

Considering the aforesaid facts, let the above named petitioners be released on bail in the event of their arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Madhepura in connection with Singheshwar P.S. Case No. 61 of 2015, subject to conditions as laid down under Section 438(2) of the Indian Penal Code.
