JUSTICE ARUN KUMAR ORAL ORDER 14-12-2017 Heard learned counsels for the petitioner and the State. The petitioner, already in custody, seeks bail in connection with Bihariganj P.S.Case No. 141 of 2016 registered under Section 392 of the Indian penal Code.

Learned counsel for the petitioner submits that petitioner is not named in the FIR and except disclosure of the name of the petitioner in the confessional statement of co-accused Manish Mahto, there is no other material, the police has submitted charge sheet in that very basis but neither he was put on TIP nor any incriminating articles were recovered from his possession and petitioner is in custody since 17.06.2017.

Having considered the aforesaid facts and circumstances, the petitioner, namely, Suraj Kumar, is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of

Patna High Court Cr.Misc. No.57782 of 2017 (3) dt.14-12-2017 2/2 the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Uda-Kishunganj, Madhepura in connection with Bihariganj P.S. Case No. 141 of 2016.
