2. Petitioner seeks regular bail in connection with Laheriasarai P.S. Case No. 553 of 2023 dated 25.11.2023 registered for the offences punishable under sections 147, 148, 149, 341, 323, 324, 307, 387, 353, 504 and 506 of the Indian Penal Code.
3. The main submissions advanced by learned senior counsel appearing for the petitioner are that the petitioner is alleged to have inflicted knife blows at the head, neck and back of the informant but on the body of the informant, only 3 injuries were found by the Doctor concerned, which were lacerated wound

No.26180 of 2025(3) dt.05-05-2025 2/3 in dimension 1x1x0.5 cm over right parietal region, an abrasion over right side of neck of size 3x1 cm and another abrasion over left lower back of size 3x1 cm and no any injury corroborating the use of knife as alleged in the FIR was found over the body of the informant and in this regard, the injury report of the informant filed with this petition as Annexure - '2' may be perused. It is further submitted that the petitioner has been languishing in jail since 18.11.2024 and against him the investigation has been completed, though he has remained accused in 9 more cases but he has got bail in most of these antecedent cases.
4. Learned APP for the State has opposed the bail prayer of the petitioner and submits that the alleged occurrence was committed with jail warden and the same happened just outside the jail premises.
5. Heard both the sides and perused the FIR and informant's injury report filed with this petition as Annexure -2. Though the petitioner has remained accused in 9 cases in addition to the present matter but the allegation made against him in the present matter does not get corroboration from the injury report of the informant as he is alleged to have inflicted knife blows on the person of the informant but no corresponding injury was found and moreover, all the injuries of the informant were opined to be simple in nature and out of 3 injuries, 2 were found as abrasion,
Patna High Court CR. MISC. No.26180 of 2025(3) dt.05-05-2025 3/3 considering this aspect as well as petitioner's custody period and completion of investigation against him, this Court is inclined to grant the relief of bail to the petitioner. Accordingly, let the petitioner named-above be released on bail on furnishing bail bond of Rs.20,000/-(Twenty Thousand) with two sureties of the like amount each to the satisfaction of the court concerned in connection with Laheriasarai P.S. Case No. 553 of 2023, on following conditions :- (i) Petitioner shall co-operate in the trial and shall be properly represented on each and every date fixed by the trial court and shall remain physically present as directed by the trial court and on his absence on two consecutive dates without sufficient reason, his bail bond shall be cancelled by the trial court. (ii) If the petitioner tampers with the evidence or the witnesses then the prosecution will be at liberty to move for cancellation of bail.
