2. The petitioner is in custody since 14.02.2016 in connection with Falka P.S. Case No. 30 of 2016 for the offences alleged under Sections 25(1-b)(a) and 26 of the Arms Act.
3. It is submitted that the petitioner has been falsely implicated when the police raided and apprehended Mahanth Mandal with country made pistol with cartridges. It is submitted that in any event, according to the seizure list, two cartridges have been recovered from possession of the petitioner but such seizure list does not contain the signature of the petitioner.
4. Having regard to the entirety of the facts and circumstances of the case, let above named petitioner be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of like amount each to the satisfaction of Sri Sunil Kumar, learned Additional Chief Judicial Magistrate-V, Katihar in connection with Falka P.S. Case No. 30 of 2016, with following conditions:
(1) That one of the bailors will be a close relative of the petitioner;

(2) That the petitioner shall remain physically present on each and every date during trial and in the event of failure to do so on three consecutive dates without sufficient reason, his bail bond shall be liable to be cancelled by the Court concerned.
