JUSTICE ASHUTOSH KUMAR ORAL ORDER 08-06-2020 Heard Mr. Devendra Kumar, learned counsel for the petitioner and learned APP for the State. The petitioner, who is in custody since 06.02.2020, seeks bail in connection with Case No. C2-96 of 2020 instituted for the offence under Section 30(A) of the Bihar Prohibition and Excise Act, 2016.

It appears that 36 litres of Nepali liquor was recovered from the possession of the petitioner. The petitioner has clean antecedents and claims to have been arrested on mistaken identity.

No.19241 of 2020(2) dt.08-06-2020 2/2 Considering the nature of accusation against the petitioner and his period of custody, he is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Addl. Sessions Judge-Cum-Special Judge, Excise, Sitamarhi in connection with Case No. C2-96 of 2020.

The application stands allowed.
