This application has been filed by the petitioner for modification of order dated 05.02.2021 passed in Cr. Misc. No. 25127/2020, whereby petitioner was allowed anticipatory bail. The bail was granted on the submission that petitioner has got no criminal antecedent and same was made a condition for grant of bail that petitioner to be released on bail only if he has no criminal antecedent.
However, later on, it has been detected that petitioner is involved in two cases, i.e., Minapur P.S. Case No.134 of 2017 under Sections 272, 273, 290 of IPC read with Sections 30(a),
Patna High Court CR. MISC. No.27490 of 2021(2) dt.04-08-2021 2/2 37 and 38 of Excise Act in which petitioner was granted bail by order dated 27.05.2017 passed by Special Judge, Excise, Muzaffapur and other case being Minapur P.S. Case No.121 of 2007 under Sections 341, 323, 353, 307, 504 of IPC read with Sections 3(i) (x) of SC/ST Act in which petitioner has been acquitted.
In view of nature of allegation made against petitioner in this case, the condition made in order dated 05.02.2021 passed in Cr. Misc. No.25127 / 2020 that petitioner should have no criminal antecedent is deleted.
Further, the date of surrender is extended for six weeks from today.
The modification petition is allowed to the extent as indicated above.
