The matter has been listed under the heading "For Orders" under the orders of Hon'ble the Chief Justice. Heard learned counsel for the petitioners, learned APP for the State and the Vigilance.

The petitioners are apprehending their arrest in a case registered under Sections 420, 467, 468, 471, 120B/34 of the Indian Penal Code.

Allegedly, the petitioners are said to have got appointment on the post of Panchayat Teachers on the basis of fake mark

It has been submitted on behalf of the petitioners that the petitioners have got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioners. The petitioners were appointed on the post of Panchayat Teachers. Subsequently, in the light of order of the Division Bench, an enquiry was handed over to the Vigilance Department to verify the documents, submitted by the appointees. It was alleged that the documents submitted by the petitioners, were fake. It is submitted on behalf of the petitioners that the documents were given to them by the institution, in question and no such act of fraud was committed on their behalf. They themselves had no knowledge that the documents, in question are fabricated one. In good faith, the said documents were accepted by the petitioners which were issued to them by the institution.

On behalf of the State, it is submitted that the petitioners are named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances of the case, let the petitioners, above named, in the event of arrest or surrender before the learned court below within a period of eight weeks from today, be released on anticipatory bail on furnishing

Case No. 24 of 2020 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
