JUSTICE SUDHIR SINGH ORAL ORDER 30-08-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 366A/34 of the Indian Penal Code.
Allegation against the petitioner is that he along with other accused persons has kidnapped daughter of the informant for the purpose of marriage with co-accused Mukesh Chaudhary. It has been submitted on behalf of the petitioner that he is in custody since 28.4.2016. Chargesheet has been submitted against the petitioner. He has got no criminal antecedent. No allegation of tampering of witnesses is alleged against the petitioner. The victim girl has been recovered. In her statement under Section 164 of the Code of Criminal Procedure she has not made any allegation of physical or sexual abuse against the petitioner. It is further submitted that petitioner may be released on bail after completion of six months in custody, i.e., from 28.4.2016.
On behalf of the State, it is submitted that petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail after completion of six
Patna High Court Cr.Misc. No.28755 of 2016 (3) dt.30-08-2016 2/2 months in custody, i.e., from 28.4.2016. on furnishing bail bond of Rs.10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nawada, in connection with Akbarpur P.S. Case no. 11 of 2016.
