The petitioner has prayed for regular bail in a case instituted for the offence under Sections 224, 225, 201, 120B, 216 and 34 of the Indian Penal Code.

As per prosecution case, three notorious criminals escaped from the Court custody when they were brought to the Court for appearance by breaking wall of the bathroom of the Hazat. The name of the petitioner transpired during investigation as the accused who helped the prisoners to escape from the Court custody.

It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case. He has committed no offence. Petitioner is not named in the FIR and

No.20416 of 2023(3) dt.17-07-2023 2/3 his name came in this case during investigation, on the basis of suspicion that one of escaped under trials was in contact with the petitioner through mobile phone. He submitted that none of the mobile phone, which was investigated by the police belong to the petitioner. The said mobile number belonged to the father of the petitioner namely Dinesh Singh, who was in contact with the escaped under trial Manish Kumar Singh and Rajnish Kumar Singh. The escaped under trials were nephew of Dinesh Singh and therefore contact between them is not unnatural or illegal. He further submitted that the escaped under trials Rajnish Kumar Singh and Manish Kumar Singh were killed in the encounter by the police and only accused Lalan Singh is yet to be apprehended. He is languishing in judicial custody since 24.11.2022.

The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as period of custody, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the
