2. The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 379, 411 of the Indian Penal Code and MMRD Act 1957 4(1), 12 BMCPIMTS, Rule 56(2), 11, 41 Act 2019.

3. Petitioner along with other accused persons are said to have involved in illegal transportation and storage of sand.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. He submits that the petitioner has been made accused in this case on basis of disclosure made by the local Chaukidar. He submits that there is no specific overt act against the petitioner. He further submits that petitioner has three criminal antecedents in which two have similar nature of offence as stated in para-3

5. Learned APP for the State opposes the prayer for bail.

6. Considering the nature of offence, I am not inclined to enlarge the petitioner on bail. Accordingly, his prayer for anticipatory bail is rejected in connection with Rajoun P.S. Case No. 280 of 2023.
