The petitioner is in custody in connection with Special Case No. 463 of 2019 arising out of Nadi P.S. Case No. 12 of 2019 for the offences under Sections 25(1-B)A, 26, 35 of the Arms Act and Section 37© of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that the petitioner has no criminal antecedent and he is in custody since 12.01.2019. He further submits that in the instant case one country made pistol was recovered from the possession of the petitioner.

Considering the fact that petitioner has no criminal antecedent and he has remained in custody for more than two

Case No. 12 of 2019.
