2. The petitioner seeks regular bail in connection with Rail Darbhanga P.S. Case No.222 of 2023 lodged under Sections 379, 411 and 414 of the I.P.C.

3. As per the prosecution case, the F.I.R. has been lodged against the petitioner with allegation that the petitioner was caught red handed at the place of occurrence and from his possession, mobile has been recovered.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Counsel further submits that the petitioner is in custody since 07.12.2023 having clean antecedent and charge-sheet has already been filed

5. Counsel further submits that the case in which the F.I.R. has been lodged, is magisterial triable in nature.

6. Learned counsel for the State opposes the prayer for bail and submits that the mobile which is subject matter of the theft, has been recovered from the petitioner's possession and in addition to other mobile, he has not disclosed anything.

7. In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail, after framing of charge, if not framed, on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-1st Class (Railway), Samastipur in connection with Rail Darbhanga P.S. Case No.222 of 2023, subject to the following conditions as laid down under Section 437(3) of Cr.P.C.
