JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-06-2019 This is an application for grant of anticipatory bail in connection with Panapur P.S. Case No. 153 of 2018, disclosing offences under Sections 420 and 409 of the Indian Penal Code. Allegation as per F.I.R. against the petitioner is that he constructed the Godown not on the gifted land rather in his own land, thus he has misappropriated the amount of Rs.3.30 lakhs. Submission of the learned counsel for the petitioner is that for the same fact and for the same cause of action, Panapur P.S. Case No. 110 of 2018 was lodged by other person and petitioner has been granted anticipatory bail, thereafter, the present case has been lodged with the same fact by Block Cooperative Extension Officer and there is allegation that he has not constructed the godown on the gifted land, rather he has constructed the same on his own land.

Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned Chief Judicial Magistrate-IV, Chapra, District Saran, in connection with Panapur P.S. Case No. 153 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
