JUSTICE RAJIV ROY ORAL ORDER 10-05-2024 Heard learned G.A.-9 representing the State who has filed the petition for restoration of C. R. No. 161 of 2017 which got dismissed for default due to non-compliance of the peremptory order on 3.2..2020.

2. Learned counsel for the petitioner submits that since the C.R. No.161 of 2017 was at nascent stage, notice was not issued to the sole opposite party and in that background, the matter can be taken up today itself for consideration.

3. Considering the facts incorporated in para-4, this

Patna High Court MJC No.533 of 2022(4) dt.10-05-2024 2/2 Court is inclined to allow the petition subject to payment of Rs. 2000/- to the Patna High Court Legal Services Committee.

4. MJC No. 533 of 2022 is allowed. The C.R. No. 161 of 2017 is restored to its original file.
