JUSTICE SANDEEP KUMAR ORAL ORDER 10-05-2023 Heard learned counsel for the petitioners and learned Additional Public Prosecutor appearing on behalf of the State. The petitioners seek regular bail in connection with Bihpur (Bhawanpur) P.S. Case No. 749/2022, registered for the offence punishable 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018.

Learned counsel for the petitioners submits that the petitioners are innocent and has falsely been implicated in this case. Nothing incriminating material has been recovered from the conscious possession of the petitioners. Petitioners are in custody since 24.12.2022.

Learned APP has vehemently opposed the prayer for

Patna High Court CR. MISC. No.19531 of 2023(2) dt.10-05-2023 2/2 bail.

Considering the nature of allegation levelled against the petitioners, their period of custody, this application is allowed.

Let the petitioners, above named, be released on bail, on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Exclusive Special Excise Judge-1, Bhagalpur in connection with Bihpur (Bhawanpur) P.S.
