The petitioner is languishing in custody in connection with Ara Rail P.S. Case No. 14 of 2016 for the offences instituted under Sections 394 and 412 of the Indian Penal Code. The prosecution case, in brief, is that while the informant was going to the residence of his cousin, four persons surrounded him and one of them put pistol upon him and another miscreants took out Rs. 9630/- from his pocket and also snatched his bag and mobile.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 16.03.2016. The charge sheet has been submitted in the present case. There is no allegation of

Patna High Court Cr.Misc. No.30979 of 2016 (3) dt.16-09-2016 2/2 tampering of witnesses alleged against the petitioner. The petitioner has been named in the First Information Report on the disclosure made by co-accused Vikash @ Dabloo, who was apprehended on the spot. The petitioner has not been put on Test Identification Parade. There is no recovery of any looted article from possession of the petitioner.

On behalf of the state it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Railway Judicial Magistrate, Ara at Bhojpur, in connection with Ara Rail P.S. Case No. 14 of 2016.
