1. Heard learned counsel for the petitioner and learned APP for the State.

2. The petitioner has preferred this application for grant of regular bail in connection with Rampur P.S. Case no. 480 of 2023 registered under sections 457 and 380 of the Indian Penal Code.

3. As per the prosecution case, unknown accused persons broke the almirah in the house of the informant and took away jewellery and cash worth Rs. 40,000/- to 50,000/-.

4. Learned counsel for the petitioner submits that the F.I.R was registered against unknown. The petitioner has been falsely implicated in the case in course of investigation in the the confessional statement of co-accused Aniket Kumar, who has himself been enlarged on bail vide order dated 12.3.2024

Patna High Court CR. MISC. No.28497 of 2024(3) dt.10-05-2024 2/2 passed in Cr. Misc. no.15111 of 2024. No incriminating article has been recovered from the petitioner's possession nor has he been put on T.I parade inspite of being in custody since 22.9.2023 and charge-sheet has been submitted in the case.

5. The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the allegations in the F.I.R, no incriminating article having been recovered from possession of the petitioner, the petitioner not having been put on T.I parade inspite being in custody for more than 7 months since 22.9.2023 and charge-sheet having been submitted in the case, the petitioner is directed to be enlarged on bail in connection with Rampur P.S. Case no. 480 of 2023, on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate- IV, Gaya.
