Earlier the prayer for bail of the petitioner was rejected twice by this Court, firstly vide order dated 31.7.2017 passed in Cr. Misc. No.34073 of 2017 and secondly vide order dated 7.2.2018 passe din Cr. Misc. No.59693 of 2017. Submission of the learned counsel for the petitioner is that he is in custody for two years and there is love affair and the public witnesses have been examined . The case is pending only for evidence of the I.O.

Heard learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant bail to the petitioner, however, if the trial is not concluded within a period of six months, the petitioner is at liberty to

Patna High Court CR. MISC. No.18609 of 2019(2) dt.11-04-2019 2/2 move for bail. At the same time, Sr. S.P., Patna is directed to ensure presence of the I.O. in this case on the next date fixed in this case and send report to this Court about the appearance and regarding evidence of the I.O. positively within a period of two months.

With the aforesaid direction, this application is disposed of.
