The petitioner seeks bail in a case registered for the offence punishable under Sections 457 and 380 of the Indian Penal Code, and later on Section 411 IPC was added. While the informant was sleeping in his house in the night, some unknown thieves entered into his house and taken away two mobiles and cash of Rs.20,000/-. It is submitted by learned counsel for the petitioner that no such occurrence as alleged ever took place. He has been falsely implicated in this case. The petitioner is neither named in
Patna High Court CR. MISC. No.18514 of 2020(3) dt.01-07-2020 2/2 the F.I.R. nor he was apprehended on the spot. No incriminating article has been recovered from his conscious physical possession. The allegation levelled against the petitioner is not specific rather general and omnibus in nature. As a matter of fact, the petitioner is a poor motorcycle mechanic and he purchased a second hand mobile from one Lalu Yadav without knowing the fact that it was stolen one and the same was recovered by the police from him. The petitioner has no criminal antecedent and has been languishing in custody since 20.11.2019.
Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty FiveThousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., West Champaran at Bettiah in connection with Bettiah Town (Kalibagh O.P.)
