Mr. APP ====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 25-11-2021 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Gurua P.S. Case No. 251 of 2018 dated 25.12.2018 instituted for the offences under Sections 399 and 402 of the Indian Penal Code and Sections 25(1-b)a, 26 and 35 of the Arms Act read with Sections 17, 18, 20 and 38 of the U.A.P. Act. Learned counsel for the petitioner submits that the petitioner is in custody since 26.12.2018, charge-sheet has been submitted in the case and he has got criminal antecedents as mentioned in paragraph '3' of the bail application. Learned counsel for the petitioner submits that allegation against the petitioner is that he was one of the persons assembled with a view to loot businessman and on search arms

Patna High Court CR. MISC. No.29943 of 2021(2) dt.25-11-2021 2/2 were recovered from the possession of the petitioner and is in custody since 26.12.2018.

Learned counsel for the petitioner submits that coaccused Jai Ram Yadav has been granted bail vide order dated 03.07.2019 in Cr. Misc. No. 41070 of 2019.

Learned A.P.P. for the State vehemently opposes the prayer for regular bail of the petitioner.

Considering the period of custody of the petitioner, the co-accused has been granted bail and charge-sheet has been submitted, let the petitioner above named be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand only) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Sherghti, Gaya in connection with Gurua P.S. Case No. 251 of 2018 subject to the condition as laid down under Section 437 (3) Cr.P.C.
