JUSTICE CHANDRA SHEKHAR JHA ORAL ORDER 05-04-2023 Learned counsel appearing on behalf of the petitioner submitted that due to negligence of the Pairvikar, inadvertently, the criminal antecedent of the petitioner was mentioned as clean in paragraph no. 3 of the earlier bail petition and therefore, the bail bond of this petitioner was not accepted by the learned Trial Court, as it was directed through order dated 22.02.2023 that if petitioner found involved in any criminal case contrary to his affidavit claiming a man of clean antecedent, the bail bond of this petitioner shall not be accepted. It is submitted that paragraph no. 3 of the earlier bail petition is to be read accordingly, as petitioner found involved in one more criminal case which is Ara Muffasil (Dhobaha O.P.) P.S. Case No. 148 of 2019 dated 22.05.2019 registered under Sections
Patna High Court CR. MISC. No.20450 of 2023(2) dt.05-04-2023 2/2 323/324/307/379/447/504/147/148 and 149 of the Indian Penal Code (for short 'I.P.C.') alongwith Section 27 of the Arms Act, where the petitioner is on bail.
Considering the submission as made above, learned Trial Court is directed to release the petitioner on bail in connection with Ara Muffasil P.S. Case No. 192 of 2021 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-VII, Bhojpur, Ara/concerned court, subject to the conditions as mentioned under Section 437(3) of the Cr.P.C., in terms of the order dated 22.02.2023 of this Court.
This order shall be treated as a part of the order dated 22.02.2023 passed in Cr. Misc. No. 66187 of 2022. (Chandra Shekhar Jha, J.) pooja/- U T
