05.08.2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The petitioner seeks bail in a case registered for the offences under Sections 147, 148, 149, 343, 323, 324, 506, 302 and 120(B) of the Indian Penal Code. The petitioner and others are named in the First Information Report with an accusation that they mercilessly assaulted the Informant's father on account of which the Informant's father died then and there. Learned counsel for the petitioner drew my attention towards post-mortem report of the deceased and submits that no external injury was found on the person of the deceased and as matter of fact the deceased died due to cardiac failure. It is further submitted that having more or less similar allegation co-accused, Bhabhikhan

Patna High Court Cr.Misc. No.30609 of 2016 (2) dt.05-08-2016 Bhagat has already been granted privilege of bail by the co-ordinate Bench of this Court.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the Petitioner, above named be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, East Champaran in connection with Turkauliya P.S. Case No. 831 of 2015.
