JUSTICE ARUN KUMAR ORAL ORDER 06-03-2018 Heard learned counsels for the petitioner and the State. The petitioner, already in custody, seeks bail in connection with Sheikhopur Sarai P.S.Case No. 111 of 2017 registered under Sections 147, 148, 149, 323, 325 and 307 of the Indian penal Code.
Allegation in brief is that at 2:00 A.M. after mid-night, informant's son was called by Ram Bilas Raut, the father of the petitioner, thereafter hearing alarm, she along with her family members reached there and found her son lying in injured condition in the house of the accused persons and when they also made an attempt to rescue him, accused persons also assaulted them. The occurrence was committed due to land dispute. Submission is that sister of the petitioner lodged a case on the same day being Sheikhopur Sarai P.S.Case No. 112 of 2017
Patna High Court Cr.Misc. No.2326 of 2018 (4) dt.06-03-2018 2/2 stating that informant's son had entered, after mid-night, into the house of the petitioner and made an attempt to rape when she raised alarm then he tried to escape and jumped from the roof top as a result he died, thereafter family members of the petitioner have been implicated in this case and two female inmates of the house, co-accused, have been admitted to bail by this Court vide order dated 14.12.2017 passed in Cr. Misc. No. 58039 of 2017. Whereas learned counsel for the informant opposed the prayer of bail and submits that injuries are not possible due to fall from the roof top.
Having considered the aforesaid facts and circumstances, the petitioner, namely, Deepak Kumar, is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned ACJM 1st, Sheikhpura in connection with Sheikhopur Sarai P.S. Case No. 111 of 2017.
