JUSTICE DINESH KUMAR SINGH ORAL ORDER 20-08-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 465, 467, 468, 406 and 420 of the Indian Penal Code.
The prosecution case is that the petitioner sold a second hand auto rickshaw to the informant for Rs.1,15,000/- for which the informant paid Rs.80,000/- and remaining Rs.35,000/- agreed to be paid in February 2015 but subsequently, the informant came to know that the auto rickshaw, in question, was purchased by the petitioner on hire purchase basis and loan amount was not paid. It is submitted by learned counsel for the petitioner that from the sale agreement, entered between the petitioner and informant, it reflects that the informant was aware about the fact that the auto rickshaw, in question, was financed
Patna High Court Cr.Misc. No.35076 of 2015 (2) dt.20-08-2015 2/2 by Bajaj Finance company. A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.
Considering the nature of accusation, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhojpur, Arrah in connection with Jagdishpur P.S. Case No.83 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
