ANJANA MISHRA ORAL ORDER 15-04-2015 Learned counsel for the petitioner submits that the case with regard to petitioner no. 1 has become infructuous on account of the fact that he has already been taken into custody and as such his application is dismissed as withdrawn. Heard learned counsel for the petitioner no. 2 and learned counsel for the State.
The petitioner no. 2 apprehends his arrest in Laxmipur P.S. Case No. 212 of 2013, registered for the offences punishable under Sections 304B/34 of the Indian Penal Code. So far as the case of petitioner no. 2 is concerned, it is submitted by the learned counsel for the petitioner that he is uncle of her husband of the deceased and the only allegation is indicated in the First Information Report is that he used to instigate the husband of the deceased to do away with her. Considering the nature of allegation and also the fact that petitioner no. 2 has no criminal antecedent, let the
Patna High Court Cr.Misc. No.39291 of 2014 (2) dt.15-04-2015 above named petitioner no. 2, in the event of his arrest or surrender before the court below within a period of two weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Jamui in connection with Laxmipur P.S. Case No. 212 of 2013, subject to the conditions as laid down under Section 438(2) of the Indian Penal Code.
