JUSTICE DINESH KUMAR SINGH ORAL ORDER 12-08-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341,323,324,379,504 and 506/34 of the Indian Penal Code.
The prosecution case is that on the order of co accused Ravindra Rajak, this petitioner assaulted the informant with iron rod causing injury on the head.
It is submitted by the learned counsel for the petitioner that the doctor has found lacerated injury of marginal size simple in nature as gets reflected from injury report contained in Annexure 2. It is further submitted that uncle of the petitioner namely Yogendra Rajak lodged Bathnaha P.S. Case No. 98 of making accusation under sections
Patna High Court Cr.Misc. No.33399 of 2015 (2) dt.12-08-2015 2/2 341,147,148,323,324,504,509,452 and 379 IPC and section 3(1)(x) of the Scheduled Caste and Scheduled Tribe (Prevention of Atrocities) Act against the informant and others, thereafter as retaliatory measure the present case has been lodged. Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Sitamarhi in connection with Bathnaha P.S. Case No.119 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
