The petitioner is languishing in custody since 23.11.2015 in connection with Sessions Trial No. 110 of 2016 arising out of Sasaram Nagar P.S. Case No. 1283 of 2015 for the offences instituted under Sections 302 and 201/34 of the Indian Penal Code.

The prosecution story, in brief, is that the informant's brother Ramesh Nut was attending Jagran programme previous night at about 12:30 night. He saw that his brother Ramesh Nut and Ravi Seth were going towards water Tanki Gali Kabristan and after sometime he saw Ravi Seth alone and asked about his brother and Ravi Seth told that his brother had gone to his house but his brother did not go to the house and early in the morning dead body

Patna High Court Cr.Misc. No.35528 of 2016 (3) dt.24-10-2016 2/2 of his brother was found near Kabristan bush and injury and blood was found over head of deceased. It is further alleged that Ravi Seth and his associates has committed murder of his brother due to previous enmity.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 23.11.2015 and the charge sheet has been submitted in the present case. The petitioner has got no criminal antecedent. There is no allegation of tampering of the witnesses alleged against the petitioner. Petitioner has been named on the basis of last seen. There is no other substantial evidence to suggest his implication in the present case.

On behalf of the State, it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 3rd Additional District & Sessions Judge, Rohtas in connection with Sessions Trial No. 110 of 2016 arising out of Sasaram Nagar P.S. Case No. 1283 of 2015.
