2. The petitioner seeks anticipatory bail in connection with Shahjahanpur P.S. Case No. 198 of 2023 registered for the offence under Section 30(a) of the Bihar Prohibition and Excise Act.

3. As per the prosecution case, illicit liquor has been recovered from the house of the petitioner.

4. Considering the aforesaid facts, this Court is not inclined to grant anticipatory bail to the petitioner.

5. Accordingly, this application is dismissed and the petitioner is directed to surrender before the Court below.

6. If the petitioner surrenders before the Court below within two weeks from today then the Special Judge,

Patna High Court CR. MISC. No.23546 of 2024(4) dt.28-06-2024 2/2 Excise, Patna City will consider the case of the petitioner on sympathetic grounds considering the fact that the recovery is of only 10 liters only and the petitioner has no criminal history. (Sandeep Kumar, J) Vikas/- U T
