The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147, 148, 149, 504, 341, 323, 325, 307, 379, 506 of the Indian Penal Code and 27 of the Arms Act.

It is alleged that on 24.10.2004 at 7.30 P.M. the informant was sitting at the door, when the accused persons including the petitioner made assault to the informant. When informant raised alarm, then his brother and son came to rescue, they were also assaulted, as a result they received grievous injury. The co-accused persons have been convicted.

It is submitted by the learned counsel for the petitioner that the petitioner was not present on the place of

Patna High Court Cr.Misc. No.35354 of 2015 (2) dt.03-09-2015 occurrence.

Considering the fact that the case was instituted in 2004 and the accused persons have already been convicted, this Court is not inclined to grant anticipatory bail to the petitioners in connection with Barbhigha P.S. Case No. 211 of 2004, pending in the Court of learned Chief Judicial Magistrate, Sheikhpura.

Accordingly, this anticipatory bail application is rejected.
