Petitioner is apprehending his arrest in a case registered for the offences punishable under Section 420 of the Indian Penal Code.

The prosecution case is that the husband of the informant entered into an agreement for sale of a Flat in favour of the informant when part consideration money of Rs. 6,51,000/- was taken by the husband of the petitioner under the agreement. The further prosecution case is that Rs. 2,00,000/- was given to this petitioner and driver of the husband of this petitioner.

It is submitted by learned counsel for the petitioner that agreement is between the husband of the petitioner and the informant. The petitioner is not a party to the agreement and there is no endorsement in the agreement

Patna High Court Cr.Misc. No.32553 of 2015 (2) dt.10-08-2015 2/2 that petitioner ever received any money from the informant. It is submitted by learned counsel for the informant that throughout the negotiation petitioner was a party to it but admits that agreement is between the informant and husband of the petitioner.

Considering the aforesaid facts, let the petitioner, above named, in the event of her arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Patna in connection with Shastri Nagar P.S. Case No. 476 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
