JUSTICE DINESH KUMAR SINGH ORAL ORDER 31-08-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 420,468,471 and 120B of the Indian Penal Code.

The prosecution has been launched by the Panchayat Secretary-cum-Member Secretary, Appointment Unit, Behari, Shankarpur block to the effect that merit list of 534 Panchayat Teachers was finally recommended by the District Education Officer for appointment on the post of Panchayat Teachers in the year 2012 but subsequently on getting the certificates verified from the Website, the District Magistrate, Madhepura found the certificates of 17 candidates as forged including that of the petitioner. It was found that the petitioner never qualified BETET examination but he

Patna High Court Cr.Misc. No.33574 of 2015 (2) dt.31-08-2015 2/2 claimed to have qualified at the BETET examination. It is submitted by the learned counsel for the petitioner that the petitioner was not ultimately appointed on the basis of selection list and similarly situated co accused have been granted anticipatory bail vide Cr. Misc. No. 12970 of 2015. Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Madhepura in connection with Shankarpur P.S. Case No.90 of 2013 subject to the conditions as laid down under Section 438(2) Cr.P.C.
