The petitioner apprehends his arrest in Complaint Case No.424 of 2017 for the offences allegedly committed by the petitioner under Sections 406 and 420 of the Indian Penal Code.

The complainant alleged that the petitioner took Rs.2,20,000/- from four persons including the complainant for preparation of Passport and Visa for sending them foreign country.

Learned counsel for the petitioner submits that no chit of paper is attached with the complaint petition showing receipt of money by the petitioner. Prior to institution of the present

Patna High Court CR. MISC. No.24644 of 2019(3) dt.27-09-2019 2/2 complaint case, the petitioner also filed complaint case on 03.02.2016 against Subhash Baitha and others. Taking into consideration the facts that of course the complainant alleged that the petitioner took money from him and from other persons for preparation of Passport and Visa but no chit of paper is attached with the complaint petition showing receipt of money by the petitioner, let petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt of the order, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, VII, Gopalganj in connection with Complaint Case No.424 of 2017, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure.
