The petitioner, who is in custody, seeks bail in connection with Marauna P.S. Case No. 110 of 2017 registered for the offence punishable under Section 366A, 34 of the Indian Penal Code.

Informant in his complaint before the Officer-inCharge in Marauna P.S. has stated that on 30.09.2017 his daughter Manju Kumari aged about 15 years had gone to see Durga Puja Festival but next day on 01.10.2017 she did not return to her house and thereafter he came to know that her daughter has been kidnapped by petitioner and on such allegation FIR was registered and the matter was investigated and the girl was recovered and

Patna High Court Cr.Misc. No.459 of 2018 (2) dt.18-01-2018 2/2 produced before the Magistrate and her statement under Section 164 of the Cr.P.C. was recorded in which she had stated that due to torture committed by her family members she with her own sweet will and volition had gone with Manoj Kumar to Delhi and she has further stated that she wants to live with Manoj Kumar. Medical report assess her age about 15-17 years. It has been further stated that petitioner has no criminal antecedent and he is in custody since 20.10.2017.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate 1st Class, Supaul, in connection with Marauna P.S. Case No. 110 of 2017.
