This is a case registered under Section 379 of the Indian Penal Code.

The FIR lodged against unknown persons discloses theft of a motorcycle from the front of the house of the informant. Counsel for the petitioner submits that the petitioner has been implicated in this case only on the basis of confessional statement of one Sohrab Alam @ Chhotu. However, no recovery has been made from his possession. He further submits that though he has been made accused in eight other cases referred in para 3 of the petition but in all the cases he is on bail. Petitioner is in custody since 03.11.2017.

Let the petitioner above named be released on bail on his furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Judge-cum-Additional Chief Judicial Magistrate 1st , Patna in Jakkanpur P.S. Case No. 120 of 2017 subject to the conditions :

(i) That one of the bailors will be a close relative of the Petitioner who will give an affidavit giving genealogy as to how he is related with the Petitioner. The bailor will also undertake to inform the Court if there is any change in the address of the Petitioner.

(ii) That the Petitioner will be well represented on each date and if he fails to do so on two consecutive dates, his bail will be liable to be cancelled.
